Terms of Service

These are the terms of service you are agreeing to by enrolling in and/or using the services of Findnot.com. It is only under these conditions that Findnot.com allows users to use their systems.

1. Findnot.com is NOT a service for the commission of criminal acts. It is an anonymity and privacy service. You agree not to violate any laws of any jurisdiction you are originating from, or terminating into. It is the responsibility of you the user to know and understand any and all relevant laws pertaining to any venue or jurisdiction that concerns you and/or your actions. Findnot.com will not be held liable in any way shape or form for actions done by it's users including criminal liability, and civil liability for damages realized or not realized beyond any monies paid to Findnot.com for it's services by a specific individual.
   
   
2. You agree to protect your user id/password and our system from unauthorized use. You are responsible for all actions that occur on Findnot.com where the login uses your user id/password.
   
   
3. You agree not to use the system for sending spam, port scanning, scanning for open proxies or open relays, sending opt-in email, unsolicited email or any type or version of email sent in large quantities even if the email is ultimately sent off of another server. You agree not to launch any pop-ups from our service. You agree not to attack in any way shape or form any other computer or network while on our service.
   
   
4. Findnot.com has pretty strong feelings against exploitation of children, digitally, photographically or otherwise. If this is your thing please leave the planet immediately.
   
   
5. Users should restrict their data transfer to 1 GIG per day. This is a soft figure. When we see a user use as much bandwidth as say 60 other "regular" users we politely ask them to stop or depart from the service and we do issue pro-rata refunds if this occurs. So what we are NICELY trying to say is hey we'll work with you as long as you are not trying to ruin it for all the others. Can't blame us here. If you have a need to occasionally use a larger amount of bandwidth drop us an email and just consider it ok, as long as it is not an everyday occurrence and it is not more than triple the limit in a 24 hour period. If you think we are unreasonable do speak out - this is a soft terms of service clause that is only intended to be used against the most inconsiderate users (think bandwidth hogs).
   
   
6. You agree not to share or give your user/password to others. Of course you are going to ask yourself since you are allowed to use the service from anywhere how would we know? The answer is we wouldn't but your account would be responsible for their actions.
   
   
7. Findnot.com. it's owners, agents, employees and others involved with findnot.com are not in any way shape or form liable for any damages of any sort realized or not realized resulting from or through the use of or arising from the use of or inability to use the findnot.com services pertaining to any registered user.
   Findnot.com can not and does not guarantee uninterrupted service. In any event findnot.com shall never be liable for any monetary damages beyond what the user paid to findnot.com and this will not include court costs or attorney fees irrespective of any statues or laws that may be interpreted otherwise. This is our binding agreement when you agree to these terms of service.
   
   
8. Findnot.com may terminate any user for violating terms of service immediately without notice or refund or suspend the account pending investigation, clarification or comment from the user. If your account is suspended (access denied) you must contact us to see if the situation can be rectified. We will wait a reasonable period of time before we permanently close a users account and shut down all billing. Since we do not require a email address from users it is the responsibility of the user to contact us by email supplying user name and password sent to: support@findnot.com, or sales@findnot.com.
   
   
9. Findnot.com only keeps log files for a 5 day period. After 5 days the log files are deleted from all sources. This is only to protect our service from abusive users. We do not get involved in any form of censorship. We do not give your personal info to any third parties. We do not cooperate with any requests for information unless we are ordered by a court of competent jurisdiction (think hold our feet to the fire) and the vast majority of these requests would not be from a court of competent jurisdiction (not from where we and our records are located), and even then without logs what could we produce - nothing of any value to anyone seeking such info. Official requests for information/subpoenas normally require more than 5 days to arrive, typically taking several months. In the event that a subpoena did show up some day (we have never been served with a valid lawful subpoena) we would be facing the subpoena without any log files since the five day period would have expired. The response to the subpoena would be along these lines: Unable to provide requested information, not in our posession. Without logs we do not know who the heck went to such and such a site at a certain date and time ! You could not find bigger privacy advocates than us. We will protect you to the max and our system is setup to automatically do so. There are hundreds of good reasons for being anonymous and we respect them fully.
   
   
10. Criminal Activity - Any user who commits any of the following criminal actions: credit card fraud, use of stolen credit cards, bank fraud, PayPal fraud, ebay fraud, e-gold fraud, fraud concerning any other online payment processor, mail fraud, blackmail, extortion, kidnapping, murder, rape, sale of stolen goods, sale of stolen credit cards, operating websites or sending email to conduct identity theft, phishing, pharming, hacking, spamming of any form in, on or through our service using any of our resources sacrifices any and all legal rights to privacy, protection, confidentiality, reasonable or fair treatment, and anything else as a user of our service one could normally expect.
    
    
11. This is the whole agreement. From time to time Findnot.com may post a new terms of service that will become binding and it is the responsibility of the users to periodically check for new Terms of Service.

Refund Policy

Our refund policy is simple. If, after diligently working with our support staff, you are unable to get connected within three days of signup, we will be glad to offer a refund. We are able to connect 99% of our subscribers, so be sure and check our website, our user forums, and always feel free to contact support@findnot.com. We do NOT offer refunds for slow server speeds or because your favorite application (p2p or otherwise) is not compatible with our system. Our servers are set up for browsing and personal email, but they can be used for p2p, ftp and other internet applications.
